Whether looking for beachfront condos or secluded homes in the countryside, assessing what aligns with your lifestyle is essential.
- Make an Offer. Once the right property is found, submit a formal offer to the seller. The offer document will outline the agreed price and proposed timeline for the transaction. Negotiations may occur, and the agent will assist with any counter-offers, ensuring the deal aligns with market conditions and property value.
- Due Diligence. Conducting due diligence is an essential step in the process. An attorney will review all contracts and property documents, confirming their compliance with Mexican law. The rate generally ranges between 2% and 4% of the purchase price, depending on the municipality. The notary collects the tax and submits payment during the title transfer process.
- Notary Public Fees and Related Taxes: The notary calculates fees as a percentage of the transaction value and oversees tax collection and deed formalization. - Fideicomiso Trust for Coastal Properties: Foreigners must use a Fideicomiso bank trust to purchase property within 50 km of the coast or 100 km of the borders. The bank holds the title as trustee, while the buyer retains full rights to sell, lease, or inherit the property. The trust ensures compliance with Mexico’s restricted zone regulations.
- Restricted Zone Authorization: Foreign buyers must obtain government authorization before establishing a Fideicomiso in restricted areas. The approval confirms that the transaction follows Mexican property laws. Without authorization, the purchase cannot legally proceed.
- Notary Public Involvement: A Notary Public oversees all legal documentation and validates the property transaction. The notary ensures the sale meets local regulations and records the deed in the Public Registry. Their involvement prevents legal disputes and protects ownership rights.
- Foreign Investment Registry: Buyers must register the property purchase with the Registro de Inversiones Extranjeras. The registration documents foreign investment and confirms compliance with national laws. Unregistered transactions risk fines or legal challenges.
- Mexican Tax Identification Number (RFC): Foreign buyers must obtain an RFC number before completing the purchase. The RFC allows payment of taxes and legal tracking of property ownership. Without it, the transaction cannot be processed through official channels.
- Proof of Funds: Buyers must provide proof of funds showing the ability to cover the purchase price. The proof demonstrates that the transaction is legitimate and financially supported. Lack of documentation delays closing or prevents approval.
- Lawyer Representation: Engaging a Mexican attorney is strongly recommended to review contracts and protect legal interests. The lawyer ensures compliance with all regulations and identifies potential risks. Representation reduces errors and safeguards the investment.
- Title Deed and Registration: The notary records the property title in the Public Registry after closing. The registration confirms legal ownership under Mexican law. Failure to register exposes buyers to disputes and weakens property rights.
